Terms of Service

Welcome to OSCELab. These terms are the agreement between you and OSCELAB — referred to here as "OSCELab", "we" and "us" — for using our website and apps. We've kept them short and in plain English: by creating an account or using OSCELab, you agree to them, so please have a read.
What OSCELab is
OSCELab is a study and exam-preparation platform for medical students and doctors. It includes practice questions, simulated patients, marking, feedback, tutorials, and related learning tools across our website and our iOS and Android apps. We're an education service — we're not a medical provider, a university, or an examining body, and we're not affiliated with or endorsed by any official exam authority.
It's for learning, not real patients
Everything on OSCELab is for education and exam practice only. It is not medical advice and must never be used to diagnose, treat, or make decisions about a real person. The scenarios, patients, and answers are simulated. Always rely on your clinical training, your supervisors, and current authoritative guidelines when caring for real patients.
Your account
- You need an account to use most of OSCELab. Please give us accurate details and keep them up to date.
- Your account is for you alone. Keep your password safe and don't share your login — you're responsible for what happens under your account.
- You need to be at least 18 to create an account and buy a plan. If you're under 18, a parent or guardian must agree to these terms on your behalf and stay responsible for your use of OSCELab.
- Email us at [email protected] if you think someone else has accessed your account.
Fair use — what we ask of you
OSCELab is for your own personal study. To keep it working well and fairly for everyone, please don't:
- Share, resell, sub-license, or publish our content, or use it to build or train a competing product or dataset.
- Copy, scrape, or bulk-download content, or use bots or automated tools to extract it.
- Use OSCELab to cheat — for example, by uploading or sharing live or recalled exam questions, or by having someone else complete your work.
- Reverse engineer, interfere with, or try to break, overload, or gain unauthorised access to the service.
- Upload anything unlawful, infringing, or harmful, or anything that contains real, identifiable patient information.
- Misuse the AI or voice features, or use OSCELab in any way that breaks the law.
AI-generated content
OSCELab uses AI to generate questions, simulated patients, marking, feedback, and conversations. AI can be wrong, incomplete, or out of date, and any feedback or score is a study aid — not a guarantee of how you'll perform in a real exam, or that our content matches the format or marking of any particular exam. Please double-check anything important against trusted sources, and don't treat AI output as clinical or professional advice.
Your inputs and uploads
You keep ownership of the files, prompts, and answers you put into OSCELab. You give us permission to store and process them so we can run the service for you — for example, to mark your answers, generate feedback, or save your progress — including sending them to the AI and infrastructure providers that power those features. You're responsible for having the right to upload whatever you submit, and please don't include real patient identifiers. The questions, marking, and feedback OSCELab creates for you stay part of our content (see below), licensed to you for your own study.
Purchases and refunds
Some features need a paid plan. Here's the deal:
- Plans are one-off purchases that give you access for a set period — there's no subscription, and we don't keep your card to charge you again.
- Prices are shown at checkout in the listed currency and may change over time, but a change won't affect a plan you've already bought.
- If you buy through the Apple App Store or Google Play, that purchase is handled by the store and its terms and refund rules apply — you may need to request a refund through them directly.
- We offer a 7-day refund window, and a pass-or-extend guarantee on eligible full-price plans of 12 months or longer: if you genuinely use OSCELab to prepare, sit the exam during your access period and don't pass, we'll extend your access rather than refund it — as long as you give us official proof from your university or college that meets the conditions on our pricing page and FAQ. Those conditions form part of these terms, and any extension is void if the purchase is later refunded or charged back.
- If these terms and our pricing page ever seem to differ on refunds or the guarantee, we'll resolve any reasonable ambiguity in your favour.
- Nothing in these terms limits the consumer guarantees you have under the Australian Consumer Law.
Our content belongs to us
OSCELab — our name, logo, software, questions, marksheets, tutorials, and the materials we generate for you — is owned by OSCELab or our licensors and protected by law. While your plan is active, we give you a personal, non-transferable, non-exclusive licence to use it for your own study, which of course includes the normal student things: taking notes, making your own flashcards, and revising from them. We keep all other rights. Exam and product names (such as GSSE, RACGP, RACP, AMC, GAMSAT and UCAT), and any third-party names or logos shown on OSCELab, are the trademarks of their respective owners and are used for identification only — they don't imply any affiliation with or endorsement by those owners.
Changes and availability
We're always improving OSCELab, so we may add, change, or remove features, and the service may occasionally be unavailable for maintenance or for reasons outside our control. We'll try hard to avoid disruption and to keep your content safe, but we can't promise the service will always be uninterrupted or error-free, or that data will never be lost — so please keep your own copy of anything you can't afford to lose.
Our responsibility to you
We work hard to keep OSCELab useful, accurate, and available, but we can't guarantee any particular exam result or outcome. Nothing in these terms excludes, restricts, or changes any rights you have under the Australian Consumer Law or any other law that can't be excluded. To the extent the law allows, and subject to those rights: we're not liable for any indirect or consequential loss, and our total liability to you for all claims combined is limited to the amount you paid us in the 12 months before the claim. Where a consumer guarantee applies and our liability can be limited, we limit it to resupplying the service or paying the cost of doing so.
Suspending or closing accounts
You can stop using OSCELab and delete your account at any time from your Profile page. We may suspend or close an account if you seriously or repeatedly break these terms or misuse OSCELab (including by sharing your account or our content), or if we need to protect OSCELab or its users. If we close your account without a fair reason while you still have paid access, we'll refund the unused portion. When an account is closed — by you or by us — we handle your data in line with our Privacy Policy.
Changes to these terms
We may update these terms from time to time. If we make a significant change, we'll take reasonable steps to let you know, and we'll always update the date at the top. Continuing to use OSCELab after a change means you accept the updated terms. If you're on a paid plan and a change meaningfully reduces what you paid for, email us within 30 days and we'll refund the unused portion of your plan.
Which laws apply
These terms are governed by the laws of New South Wales and the Commonwealth of Australia. If there's ever a dispute we can't sort out together, it will be handled by the courts of New South Wales.
